CRL.REV.P.(MAT.) 162/2026 & CRL.M.A. 9091/2026 (stay) By way of the present petition filed under section 438 read with section 442 of the Bharatiya Nagarik Suraksha Sanhita 2023 ('BNSS'), the petitioner impugns order dated 07.02.2026, whereby the learned Family Court has declined to stay its order dated 03.12.2025.

Vidé order dated 03.12.2025, the learned Principal Judge, Family Court, North-West District, Rohini Courts, Delhi had awarded adinterim maintenance of Rs. 10,000/- per month to be paid by the petitioner to his wife, the respondent herein; and a sum of Rs. 10,000/- per month to their minor child.

The record shows, that the aforesaid proceedings are still pending before the learned Family Court; and are listed next for Petitioner's Evidence, as well as for reply and arguments on a pending application.

The court is informed that by way of the application, the petitioner has sought modification of order dated 03.12.2025, which application is pending consideration before the learned Family Court. 5.
In view thereof, and keeping in mind section 438(2) of the BNSS, this court is not inclined to entertain the present petition, which is accordingly dismissed at the stage of issuance of notice itself. 6.
