O R D E R

By way of the present writ petition, the petitioner seeks following reliefs:

"a) Issue appropriate writ, order or direction directing the Respondents to immediately conduct the required cardiac procedure (stent placement) of the Petitioner in a time-bound manner, preferably within 1-2 days;

b) Direct the Respondents to present complete medical records of the Petitioner from 20.02.2026 till date c) Direct the Respondents to permit family members to provide necessary medical equipment and attendant care;" 2.

The learned counsel appearing for the petitioner states that the petitioner is 61 years old and has been in judicial custody for about 2 years and 5 months. were assured that the condition was not serious and was only related to elevated sugar levels. On 08.03.2026, the petitioner was admitted to Safdarjung Hospital, where he was administered oxygen support and discharged after three days. It is stated that during this period, the family members were not permitted to meet the petitioner and were repeatedly informed that his condition was stable. Shockingly, on 20.03.2026, the petitioner was again admitted to Safdarjung Hospital, and it has now come to the knowledge of the family that the petitioner has suffered a heart attack. It is therefore stated that the family of the petitioner are willing to bear the cost of stent placement procedure and other necessary medical intervention; however, no steps have been taken by the respondents, which has compelled the petitioner to approach this Court.

The medical status report prepared by the Senior Medical Officer, Central Jail No. 1, Tihar, New Delhi, has been handed over to this Court wherein it has been reported that the surgery of the petitioner is scheduled to be conducted today at Safdarjung Hospital. The said report is reproduced as hereunder:

"With reference to the Hon'ble High Court seeking medical report of the foresaid inmate/patient to be submitted as per given date. As per available medical record, inmate patient is a follow up case of Type II Diabetic Mellitus, Hypertension, CAD, Psoriasis and TVD for which he has been under regular follow up with duty doctor, Jail visiting specialists and DDU Hospital/ Safdarjung Hospital. In continuation with the previous report dated 28.03.2026 (D.No.01/SMO/C.J-01/2026/368), it is humbly submitted that inmate patient was send to Safdarjung Hospital Cardiology Department on 30.03.2026 for further review and management wherein doctor reviewed and examined the inmate patient and advised medications and refer the patient to CTVS Department (Cardio Thoracic Vascular Surgery) for CABG (Open Heart Surgery) and further management. Accordingly, inmate patient is scheduled for CTVS Department The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

At present inmate patient is admitted in CJ-01 Dispensary MI Room." 4.

In view of the above, it is directed that appropriate treatment shall be provided to the petitioner. At the same time, one family member of the petitioner i.e., his wife, Ms. Sadhna, shall be permitted to accompany the petitioner in the hospital and stay as his attendant, as per rules of the hospital. However, she will not be permitted to carry her mobile phone during the time she is accompanying the petitioner. 5.

Accordingly, the present petition is disposed of with above directions. 6.
