W.P.(CRL) 554/2019 Grievance of the petitioner in the present petition is limited. Petitioner has been granted furlough by the Competent Authority vide order dated 22nd January, 2019, however, the petitioner cannot be released as one of the co-convicts has been released on parole w.e.f. 29th January, 2019. A perusal of the nominal roll of the petitioner reveals that the petitioner has been getting regular furloughs by the Competent Authority and there is no allegation that he misused the same. W.P.(CRL) 554/2019

The reason for the petitioner seeking preponement of release on furlough is the marriage of the niece which is fixed for 21st February, 2019. Though the factum of marriage of the niece has not been verified but as per the nominal roll the petitioner has been granted furlough for a period of two weeks vide order dated 22nd January, 2019 which the petitioner can avail. Thus, this Court directs that the petitioner be released on furlough on complying with the other conditions in case the surety bond and fresh personal bond are submitted irrespective of the fact that the co-convict has also been released on furlough w.e.f. 29th January, 2019. Application is disposed of.
