It is the petitioner's case that the respondents are in breach of this Court's order dated 10.01.2019 directing them offer appointment for the post of Constable (GD) in CISF within two weeks from the date of receipt of the Court's order dated 10.01.2019. The petitioner has been offered an equivalent post in ITBP. The medical examination for the post of Constable (GD) in ITBP is to be held on 15.03.2019. It is the petitioner's case that if he is not examined and not allowed to participate in the said medical examination, he may well lose out his chance to join the said Force. Mr. Amit Mahajan, the learned Central Government Standing Counsel submits that the petitioner has been offered a post in ITBP on the basis of merit-cum-preference. He submits that nevertheless an application seeking

modification of the aforesaid order dated 10.01.2019 is likely to be moved by them by tomorrow, to the effect that in terms of the petitioner's merit-cum-preference, he would be entitled only to an offer of appointment in ITBP and not in CISF. Be that as it may, the petitioner's rights and interests are secure in terms of the aforesaid order. However, lest he miss-out on the presently offered post of Constable (GD) ITBP, let him be medically examined on the date so fixed. The respondent shall ensure that the petitioner is medically examined for the offered post. The application is disposed-off in the above terms. CONT.CAS(C) 141/2019 Renotify on the date fixed i.e. on 29.03.2019. A copy of this order be given dasti to the learned counsel for the parties under the signature of the Court Master.
