The instant petition is for the following reliefs:- "a) Pass an appropriate Writ, Order or direction in the nature of Certiorari directing the Respondents to immediately preserve, secure and produce before this Hon'ble Court the complete judicial record of Civil Suit No.8259/2016 (CNR No. DLWT030000351999) titled " Man Singh & Anr. Vs. Banwari Lal & Anr." along with the entire record of Miscellaneous Applications bearing Misc. No. 291/2017, Misc. No.292/2017, Misc. No. 293/2017 and Misc. No. 244/2019, as well as case File No. 360/Vig/PD&SJ WEST/ Delhi/2025, so as to ensure preservation of the judicial record and prevent any further tampering, alteration, removal or replacement of documents; b) Pass an appropriate Writ, Order or direction in the nature of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Certiorari quashing and setting aside the order dated 17.01.2026 passed by Respondent No. 2 in Case File No. 360/Vig/PD&SJ WEST/Delhi/2025 on the basis of comments of the Ld. Investigating Officer, which are factually incorrect, baseless and contrary to the court order sheets, judicial record/documents, the said order having been passed without due verification thereof and in violation of the principles of natural justice;

c) Pass an appropriate Writ, Order or direction in the nature of Mandamus directing the Respondents to constitute a committee for conducting an inquiry into the tampering of the judicial record, and timebound inquiry, preferably under the supervision of this Hon'ble Court, into the tampering, alteration, replacement and removal of documents from the judicial record of the aforesaid case, and to identify the person(s) responsible therefore as well as the person(s) who may have derived or may be derive benefit from such alteration; d) Pass an appropriate Writ, Order or direction in the nature of Mandamus directing the Respondents to permit the Petitioner to obtain certified copies of the entire record of Civil Suit No. 8259/2016 (CNR No. DLWT030000351999), all connected Miscellaneous Applications bearing Misc. No. 291/2017, Misc. No. 292/2017, Misc. No. 293/2017 and Misc. No. 244/2019, as well as case File No. 360/Vig/PD&SJ WEST/ Delhi/2025, so as to enable the Petitioner to avail appropriate legal remedies in accordance with law."

The order dated 17.01.2026 passed by the Officer-in-Charge Vigilance, West would clearly indicate that the request for preservation of the requisite record has been duly considered and a conclusion has been reached that there is no reason to assume any tampering with the judicial records.

The Court is in the full agreement with the reasons assigned in the Impugned Order. The petitioner will have to undertake an appropriate remedy, in accordance with law, to assail the finding rendered by the respondent. The said authority, can also, in the interregnum, pass appropriate directions, for mitigating the petitioner's grievance, if found appropriate.

The writ Court in exercise of its power under Article 226 of the Constitution of India cannot pre-empt and presuppose any tempering in any of the Courts' records. The Courts' record are maintained and preserved as per the extant rules and regulations and cannot be permitted to be tampered with by any person. Even its veracity cannot be challenged without there being any proper justification.

For all the aforesaid reasons and finding no merit in the instant petitions, the same stands dismissed.
