% 30.11.2015 CM 1727/2015 (condonation of delay) We have heard the learned counsel for the parties. We have also seen the order dated 02.12.2014 passed by a Division Bench of this court in a FAO(OS) 500/2014 whereby liberty was granted to the appellant to file a comprehensive appeal even assailing the earlier order dated 17.07.2014. In view of the same, the delay is condoned.

The application stands allowed.

FAO(OS) 50/2015 We have heard the learned counsel for the parties. We are of the view that the written statement filed by the appellant/defendant be taken on record. But this would be subject to payment of costs of Rs. 10,000/- to the respondent. The costs shall be paid within one week.

The appeal stands allowed as above.
