This application has been filed by the petitioner seeking to withdraw this contempt petition, with liberty to approach the competent Tribunal for seeking relief in consonance with the directions passed by this Court by order dated 24th January 2024 in W.P.(C) 11790/2023. 2.

Mr. Abhinav Mukerji, Senior Counsel for the petitioner, informs the Court as regards the performance security, the said amount has been now refunded.

However, as regards the invocation of the bank guarantee, they seek liberty to approach the Tribunal yet again for seeking appropriate relief. 4.

In this view of the matter, the application is allowed and is disposed of.

The petition is, therefore, disposed of.

Liberty is granted to the petitioner in view of order dated 24th January 2024.

The relevant paragraph of the said order is extracted as under: 4.

Accordingly, directions are passed to the respondent in terms of the said order, as extracted above, and they are restrained from invoking the bank guarantee till the application for interim relief is decided by the Tribunal.
