By way of the present application filed under Section 394 read with section 482 of Cr.P.C. read with Sections 435 and 528 BNSS, 2023, the applicant seeks abatement of the present appeal on account of the death of the appellant.

Learned counsel for the applicant/appellant submits that the appellant has since expired. He, on instructions, submits that the legal heirs of the appellant do not wish to press the appeal on merits. 3.
Learned counsel for the respondent submits that the factum of appellant's death stands verified through the report received on the date 21.04.2025 along with the death certificate which confirms that the appellant expired on 28.01.2025 and brings attention to the aforesaid which is placed on record.

In view of the fact that the appellant has expired during the pendency of the appeal and that his legal heirs do not wish to contest the matter, the application is allowed.
