By way of the present petition, petitioners seek quashing of the FIR bearing no. 226/2017, registered at Police Station Model Town, Delhi, for the commission of offence punishable under Sections 328/376/354/354A/506/509/120-B of the Indian Penal Code, 1860 (hereafter 'IPC') and all proceedings arising therefrom. 2.

Issue notice. The learned APP accepts notice on behalf of the State. 3.

The petitioners and respondent no. 2 are present before this Court and have been identified by their counsel and Investigating Officer (IO) concerned from Police Station Model Town, Delhi. Brief facts of the case are that respondent no. 2 and the petitioners were students and were studying in same institution at the time, when the alleged incident had happened. They were classmates and due to some misunderstanding, on the complaint of the complainant/respondent no. 2, the present FIR was registered. After investigation, the chargesheet was filed before the concerned Court. It is stated that during pendency of the trial, the parties have amicably settled their disputes vide Memorandum of Understanding dated 11.03.2026.

On a query made by this Court, respondent no. 2, who has been identified by the IO, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat. Therefore, she has no objection if the present FIR is quashed. 6.

On instruction from the concerned I.O., the learned APP for the State informs this Court that chargesheet in this case was filed for offence under Section 328/376/354/354A/506/509/120B of IPC, however, the petitioners were discharged under Section 376 of IPC and charges have been framed against petitioner (i) Sanjay Kumar Jha for offence under Section 328/354/354B/323 of IPC, (ii) Ajay Kumar Yadav for offence under Section 354/509 of IPC and (iii) Dibyajyoti Dass for offence under Section 109/328/354/509 of IPC.

In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. Accordingly, FIR bearing no. 226/2017, registered at Police Station Model Town, Delhi, for the commission of offence punishable under Sections 328/376/354/354A/506/509/120-B of IPC and all consequential proceedings emanating therefrom are quashed, subject to the petitioners depositing cost of Rs.15,000/- each (total ₹45,000/-), out of which Rs. 30,000/- with the District and Sessions Courts Employees Welfare Association Fund and Rs. 15,000/- with the Delhi High Court Employees' Welfare Fund, within a period of seven days from date and the compliance report be filed with the Registrar General of this Court. 9.

In view of above, the present petition stands disposed of. 10.
