The present application seeks to bring on record the Legal Representatives of Late Sh. Jai Narain Garg who is stated to have expired on 19th February 2019. The summons have not been issued in the present suit.

2. In view of the averments made in the application, the same is allowed and the legal representatives of the Plaintiff are taken on record.

3. Plaintiff is directed to file amended memo of parties within a period of one week from today.

4. Learned counsel for the Legal Representatives of the Plaintiff, Mr. Ashwani Kumar Singh, states that he has instructions to withdraw the present suit.

5. Accordingly, the suit along with the pending application is dismissed as withdrawn.
