The application is disposed of.

CS(OS) 65/2017 & IA No.1944/2017 (u/O XXXIX R-1&2 CPC) 3.

The sole plaintiff and the sole defendant in this suit for (a) partition of property No.X/81, Tagore Gali, Mohalla Ram Nagar, Gandhi Nagar, Delhi110031; (b) declaration as null and void of the document dated 1st July, 2016 claimed by the defendant to be the Will of the mother of the parties; and, (c) permanent injunction, were vide order dated 8th September, 2017 referred to the Medication Cell of this Court.

Mediation has been successful with the efforts of Mr. Pramod Gupta, Advocate/Mediator and Interim Settlement Agreement dated 28th July, 2017 and now a Settlement Agreement dated 12th January, 2018 have been received from the Mediation Cell of this Court. CS(OS) 65/2017

The counsel for the plaintiff and the counsel for the defendant support the settlement and seek disposal of the suit in terms thereof. 6.

The parties have agreed that the plaintiff and the defendant have 50% undivided share each in the property and to withdrawal of the suit in view of the said Settlement.

The compromise arrived at between the parties is found to be lawful. 8.

The counsel for the plaintiff, in view of the Settlement, withdraws the suit.

9.

The suit is dismissed as withdrawn. However, the parties to remain bound by the Settlement arrived at between them. No costs.
