% 25.02.2019 The learned counsel for the petitioner has placed on record the copy of the order dated 2.8.2018 of this Court in CM(M) 372/2018 which had been filed by the respondents No. 1 and 2 arrayed to the present petition as the petitioner of the said petition.
Vide the observations dated 2.8.2018 it had been observed categorically to the effect that the respondent No.1 i.e., the present petitioner to the present petition CM(M) No. 372/2018 would adhere to the submissions made and that the evidence of the respondent No.1 would be led on 23.8.2018 to which the learned counsel for the petitioner herein submits that the same has been led but that an application for amendment has been filed by the petitioner during the course of the proceedings before the learned Trial Court.
On behalf of the respondents No.1 and 2 it has been submitted that vide order dated 18.9.2018 in the said petition a status report has also been
called from the learned Trial Court.
In view of the specific submissions having been made by the respondents No. 1 and 2 that the petitioner was adopting dilatory tactics during the course of submissions that have been made on 22.2.2019 and which are reiterated now on behalf of the petitioner, the learned counsel for the petitioner has only prayed to the effect that the submissions sought to be made now were confined to the effect seeking waiver or reduction of the costs as imposed vide order dated 19.12.2018. Taking into account the factum that the costs imposed are of Rs.10,000/- to each of the plaintiffs, in the interest of justice, the costs are reduced to Rs.5,000/- to each of the plaintiffs in terms of the order dated 19.12.2018.
