Vide order dated 23.01.2025 in CM(M) 3650/2024, the learned Single Judge of this Court passed the following directions: "2. Learned counsel for the petitioner submits that petitioner is a senior citizen and has made a complaint in the office of Deputy Commissioner, Kapashera on 01.03.2024 that his wife and son have beaten him and has made request that the possession of his house be restored, but no action has been taken on his complaint till date.

3. Learned counsel places reliance on Rule XXII (3) of The Delhi Maintenance and Welfare of Parents and Senior Citizen Rules, 2009 which provides the procedure for eviction from property/residential building of senior citizen/parents. 4.

The only request made before this Court is that necessary directions be issued to Deputy Commissioner, Kapashera for expediting action on the complaint dated 01.03.2024. 5.

None appears on behalf of the respondents today. 6.

Since a limited prayer has been made, the petition is disposed of with directions to respondent No.1 to take necessary action on the complaint dated 01.03.2024 as per the law in an expeditious manner."

Vide order dated 22.07.2025, the predecessor Bench of this Court directed the petitioner to appear before the SDM, Kapashera on 30.07.2025 at 02:00 PM and further, that the complaint filed by the petitioner be decided in an expeditious manner, not exceeding 2 months from the said date. 5.

In compliance thereof, learned counsel for the respondents has handed up in Court today, order dated 19.09.2025 passed by the District Magistrate Cum Appellate Tribunal, whereby the complaint/ application of the petitioner has been decided by a speaking order. In view of the above, the present petition is disposed of. 7.

Needless to state that the petitioner, who appears in person, is always at liberty to challenge the order dated 19.09.2025 passed by the District Magistrate before the competent jurisdiction/Authority. 8.
