The present writ petition under Articles 226 and 227 of the Constitution of India seeks to assail the order dated 19.01.2023 passed by the learned Central Administrative Tribunal in O. A. NO. 3903/2016. From a perusal of the impugned order, we find that the learned Tribunal has allowed the original application preferred by the respondents in terms of the order passed in O.A. which was in turn disposed on the basis of the order passed in O.A. No. 2995/2014. The order in this O.A. No. 2995/2014, is, however, subject matter of consideration in W.P. (C) 18/2015 which is still pending adjudication. In fact, we find that while passing the impugned order, the learned Tribunal has itself made it clear that the relief being granted to the respondents would remain subject to W. P. (C) 18/2015 wherein the order passed in O.A. No. 2995/2014 has been assailed by the petitioners herein.

In the light of the aforesaid specific directions issued by the learned Tribunal, we find no reason to interfere with the impugned order. We, therefore, dispose of the present writ petition by making it clear that the respondents would remain bound by the orders passed in W.P. (C) 18/2015 and the amount in terms of the impugned order will be released in their favour subject to their filing undertakings before the learned Tribunal within two weeks from today to remain bound by the order passed in W. P. (C ) 18/2015.
