On 23rd May, 2019 this Court had passed the following order:- "1.
Learned counsel for the Respondent has handed over the letter addressed to him wherein the name of the Arbitrator has been suggested. A copy of the said letter has been furnished to the learned counsel for the Petitioner. Learned counsel for the Petitioner seeks time to take instructions.

List on 21st August 2019."

Suffice it would be to state that the respondent had suggested the name of Mr.Dinesh Kumar, Retired Engineer-in-chief, PWD, Delhi, to act as an Arbitrator.

The learned counsel for the petitioner has no objection for Mr.Dinesh Kumar, Retired Engineer-in-chief, PWD, Delhi, to act as an Arbitrator. His only submission is that Mr. Dinesh Kumar, Retired Engineer-in-chief, PWD,
Delhi, should hold the proceedings under the agies of the Delhi International Arbitration Centre and the Rules made thereunder. This plea of learned counsel for the petitioner is opposed by Mr.Shadan Farasat, learned ASC for the respondent.

I am not inclined to accede to the request made by learned counsel for the petitioner, except that the counsel for the parties shall be at liberty to request the learned Arbitrator for regulating his fee under the Provisions of DIAC Rules.

The respondent shall accordingly issue an order appointing Mr.Dinesh Kumar as an Arbitrator within two weeks from today. 6.
The petition is disposed of.
