The present writ petition has been filed seeking a direction to the respondent no.1/MCD to demolish the unauthorized construction carried out by the respondent no.3 in the shape of fourth floor of property bearing no.8A/65, W.E.A., Channa Market, Karol Bagh, New Delhi - 110005 (hereinafter 'subject property').

Counsel appears on behalf of the respondent no.1/MCD on advance notice and submits that the subject property was booked on 3rd February, 2026 and a show cause notice was issued.

After giving a personal hearing to the owner/occupier, a demolition order has been passed on 24th March, 2026 declaring that the construction carried out on the entire fourth floor of the subject property is in violation of W.P.(C) 3879/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. the sanctioned building plan and is unauthorized. 3.1.

An opportunity has been given to the respondent no.3 to demolish the unauthorized construction within fifteen (15) days. 3.2.

The aforesaid documents have been handed over in Court today and are taken on record.

Accordingly, the present writ petition is disposed of while directing the respondent no.1/MCD to take appropriate action in terms of the demolition order passed on 24th March, 2026.

Liberty is given to the petitioner to take appropriate remedies available in law in the event the petitioner has further grievances. 6.

Needless to state all rights, contentions and legal remedies of the private respondent no.3 are kept open.
