% 21.02.2019 Respondent no.2-Mr. Gopal @ Jay Gopal is present in Court and has been identified by ASI Nagender Singh of police station Model Town. He submits that he has settled the matter with petitioners of his own free will and without any undue force, pressure or coercion vide Compromise Deed dated 03.01.2019. In terms of the settlement, petitioners have paid `1.40 lacs to the respondent no.2 today in Court vide a demand draft, photocopy whereof has been placed on record. Respondent no.2 submits that with this payment entire settled amount of `1.50 lacs stands paid and he has no objection in case FIR No. 582/2017 under Sections 279/337/338 IPC police station Model Town and the consequent proceedings are quashed.
Keeping in mind the settlement arrived at between the petitioners and respondent no.2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
