Bail Appln. no. 368.2020 In as much as, the applicant seeks the grant of interim bail submitting to the effect that his mother's surgery is fixed for the date 10.02.2020, the status report/verification report of documents submitted at pages 44 & 45 of the petition be put up by the State at 1.15 PM today.

As per the information received by the learned APP for the State through the Investigating Officer, the surgery of the petitioner's mother is to be performed at the Metro Hospital, Noida. In the circumstances, the applicant is allowed to be released on interim bail for a period of 10 days from the date of his release on his furnishing a personal bond in the sum of Rs.1,00,000 with one surety in the like amount to the satisfaction of the Trial Court with the directions that he shall not leave the area of NCR and shall surrender before the Superintendent (Jail) Delhi on the 10th day of his release. Learned counsel for the complainant is present and opposes the present bail application submitting to the effect that the applicant can be granted custody parole.

Taking into account the factum that it has been informed on behalf of the State through the verification conducted that the surgery to be performed on the petitioner's mother is a life saving surgery, it is not considered appropriate to revoke the interim bail granted herein above.

The petition is disposed of.

Copy of the order be given Dasti, under the signatures of the Court Master, as prayed.
