The petitioner seeks probate of the will dated 20.03.2017 of Late Shri. Ayodhya Prasad Tripathi. However, in view of the fact that the petitioner is not the named executor of the said will, the present petition is not maintainable in terms of Section 222 of the Indian Succession Act, 1925.

Learned counsel for the petitioner therefore seeks leave to withdraw the petition with liberty to institute appropriate proceedings. 3.
