CORAM:

HON'BLE MS. JUSTICE REKHA PALLI

O R D E R

% 07.02.2020 I.A. 1800/2020 (exemption) 1.

Exemption granted subject to all just exceptions. 2.

The application is disposed of.

O.M.P.(MISC.)(COMM.) 52/2020 3.

This is a joint application filed by the petitioner and the respondent seeking extension of time for completion of arbitration proceedings and rendering of the award.

4.

Learned counsel for the parties submit that the learned Arbitrator had entered reference on 10.12.2016 but despite the parties diligently participating in the arbitration proceedings, the same have yet not concluded and in the meanwhile, the mandate of the Arbitrator has expired on 31.12.2019. They, therefore, pray that the time for completion of proceedings and rendering of the award be extended for a further period of eight months effective from 31.12.2019.

5.

Keeping in view the fact that much time and labour has already been invested in the proceedings, the time for completion of arbitration proceedings and rendering of award is extended by eight months effective from 31.12.2019. The mandate of the learned Arbitrator is thus extended till 31.08.2020.

6.

The petition is disposed of in the aforesaid terms. REKHA PALLI, J.
