W.P.(CI 1424/2020 and C.M.4955/2020 (stavl A writ petition filed earlier assailing order dated 10.08.2018 of the Central Administrative Tribunal ('Tribunal') in O.A. No. 1407/2015 was allowed in part by this Court by order dated 20.05.2019, whereby the Division Bench of this Court had directed the respondents to consider the petitioner's claim for compassionate allowance under Rule 41 of the CCS (Pension) Rules, 1972 if he were to make an application. An application having been made, stands rejected by respondents' order dated 07.10.2019; which has led to the filing of the present petition.

After some hearing in the matter, learned counsel for the petitioner Certify that the digital and physical file have been compared and the digital data is as per the physical file and no page is missing.

submits that since rejection of the application is a fresh cause of action, he would assail the same in accordance with law. The petition and C.M.4955/2020 are accordingly dismissed as not pressed.
