BAIL APPLN. 974/2025 1.

This is a petition seeking grant of anticipatory bail in the FIR No. 25/2021 dated 18.01.2021 registered at P.S. Model Town under Sections 420/34 of IPC.

As per the FIR, it is stated that the petitioner had purchased some channa from the complainant and made some payment, but did not make the entire payment. Hence, the FIR.

During the pendency of the proceedings, the parties have settled their disputes vide settlement dated 18.02.2025, wherein the outstanding amount of Rs. 15 lakhs has been paid to the complainant. 4.

states that the matter has been settled and he has no objection for grant of anticipatory bail. He further states that a joint compounding application has already been moved before the learned MM. 5.

Learned Sessions Court on 05.03.2025 was pleased to reject the anticipatory bail application of the petitioner on the ground that the NBWs had been issued qua the petitioner and he had been evading arrest.

Ms. John, learned senior counsel for the petitioner states that since the matter has been settled and the petitioner undertakes to appear before the concerned Court at the time of compounding and as and when the learned Trial Court so directs, the NBWs may also be cancelled by this Court.

Since the matter has been settled and since the learned senior counsel for the petitioner has undertaken that the petitioner shall appear before the concerned Court on each and every date of hearing and as and when the directed by the learned MM, I am of the view that the NBWs need to be cancelled. Additionally, the petitioner has already settled the disputes and the complainant has received the balance outstanding amount from the petitioner.

Keeping in view the aforesaid facts and circumstances of the present case, the present petition is allowed. It is directed that in the event of arrest, the petitioner be released on bail subject to his furnishing a personal bond in the sum of Rs. 10,000/- to the satisfaction of the concerned Investigating Officer and also subject to the following further conditions:- (i) At the time of furnishing bail bond, the petitioner shall The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

provide the mobile number, which he undertakes to keep operational at all times during the pendency of the trial. (ii) The petitioner shall inform the concerned Investigating Officer about his current residential address. (iii) In case of change of residential addresses/contact details, the petitioner shall promptly inform the same to the concerned Investigating Officer/SHO.

(iv) The petitioner shall regularly appear before the learned MM. 9.

Additionally, the NBWs issued against the petitioner on 06.03.2025 stand cancelled.
