O R D E R
% 30.01.2017 The petitioner seeks regular bail under Section 439 Cr.P.C. in case FIR No.559/2016 under Sections 304B/ 498A/ 302/ 201/ 34 IPC registered at PS - Ranhola.
The petitioner is the mother-in-law of the deceased. The deceased has died of manual strangulation and ante-mortem injuries. The co-accused, i.e. the husband of the deceased/ son of the petitioner, on his disclosure statement implicated the petitioner by describing her role in the commission of the offence.
At this stage, I am not inclined to grant bail to the petitioner.
It is informed that the matter is now coming on 09.02.2017 before the Trial Court for consideration on the aspect of framing of charge. The Trial Court shall proceed with the case on that date and no adjournment shall be sought either by the accused or by the prosecution and none shall be granted. If the matter proceeds to trial, the Trial Court shall also expedite recording of evidence of material/ independent witness, whereafter the prayer of the petitioner to seek bail would be considered.
