% 21.02.2019 Issue notice. Mr. Sanjay Lao, the learned counsel for the State accepts notice. At joint request, the petition is taken up for final disposal.

On 16.01.2019, a representation had been made before the Trial Court that the petitioner was unable to attend the Court since he was indisposed. The case was scheduled for 14.02.2019 subject to a cost of Rs.2,000/-. On the latter date, the petitioner defaulted in appearance hence, Non Bailable Warrants (NBWs) were directed to be issued against him.

The learned counsel for the petitioner submits that the petitioner has been diagnosed with a serious medical ailment which requires surgery and hence he could not appear before the Court on the said date. He undertakes to appear before the learned Trial Court whenever the date is fixed.

In the circumstances, the NBWs directed to be issued against the petitioner is stayed. He is directed to appear before the Court on 28.03.2019.

The petition is disposed off in the above terms. A copy of this order be given dasti to the learned counsel for the petitioner under the signature of the Court Master. NAJMI WAZIRI, J.
