The learned counsel appearing for the parties state that the issues involved in the present petitions are squarely covered by the decision of the of the Division Bench of this court in Nitu and Ors. v. The Govt. of National Capital Territory of Delhi and Ors.: W.P.(C) 4414/2012, decided

on 04.01.2016.

The learned counsel appearing for the petitioners further states that the present petitions may be disposed of in terms of para 38 of the said decision, which reads as under:- "38. However, keeping in view that by interim order dated 25.07.2012, stay of eviction of the petitioners has been granted and that the said order has been in operation all through, we consider it appropriate to permit the petitioners herein to submit their objections, if any, to the Sub-Divisional Magistrate, Paharganj, Delhi within four weeks from today. If any such objections are received within the time fixed above, the SDM shall consider the same and pass appropriate orders in accordance with law. Till such time, the petitioners herein shall not be evicted from the premises in question."

The learned counsel appearing for the respondents has no objection to the orders being passed in the aforesaid terms. 3.

Accordingly, the present petitions are disposed of by directing the petitioners to submit their objections, if any, to the Sub-Divisional Magistrate, Paharganj, Delhi within a period of four weeks from today. If such objections are made within the aforesaid period, the concerned SDM shall consider the same and pass an appropriate order in accordance with law. The petitioners shall not be evicted till such orders are passed. VIBHU BAKHRU, J OCTOBER 25, 2018 MK
