The petitioner has filed the present petition, inter alia, praying that he be released on bail in connection with FIR No. 342/2019 under Sections 420//468/471/120B of the IPC, registered with Police Station Subhash Place, Delhi.

The said FIR was registered at the instance of Bajaj Finance Limited. The said company is a non-banking financial company and it was, inter alia, alleged that the petitioner and the other co-accused were a part of the conspiracy that resulted in the complainant providing loans to fake customers.

The complainant invites applications for loans from its online platform (www.bajajfinservmarkets.in). The customers, who require credit, fill their online details. Their details are examined and thereafter, a soft approval is granted by the credit manager. The matter is then transferred to

a local sales manager for collection of documents and Geo tagging. The sales manager collects the documents through his off-roll employees. He is required to scan the collected documents and submit the same for further approval.

It is alleged that the petitioner was an employee of a company "Team Lease Services Private Limited" and their services were engaged for collection of forms for Geo tagging. The petitioner was required to go to each customer assigned to him, collect the documents and take photographs (which were Geo tagged). The said documents were then submitted to the manager (one Abhishek Gulati). It is alleged that the petitioner is a part of the conspiracy as he had assisted in submission of documents of fake customers along with his brother Avinash Kumar. The sales manager (Abhishek Gulati) is absconding and so is the petitioner's brother Avinash Kumar.

The status report indicates that the investigation is still not complete.

Considering that the investigation is not complete and two of the coaccused are absconding, this Court does not consider it apposite to allow the present petition at this stage.

It is expected that the investigation would be expedited. The petitioner was arrested on 10.10.2019. The petitioner is at liberty to apply after three months.
