% 22.02.2019 After some arguments, learned counsel for the petitioner states that due to an inadvertent error, the order dated 31.01.2017, whereunder the issue of inquiry was held against the petitioner/workman by the learned Labour Court has not been impugned while laying challenge to the subsequent award rejecting the petitioner's claim. He, therefore, seeks leave to withdraw the present petition with liberty to file a comprehensive writ petition impugning the order dated 31.01.2017 as also the award impugned in the present petition.

Leave as prayed for is granted. The petition is dismissed as withdrawn along with the pending application. It is made clear that it will be open for the petitioner to take all grounds including the grounds taken in the present petition.
