% 30.08.2018 Learned counsel for the petitioner submits that petitioner is 60 years old woman.
She is mother-in-law of deceased who had committed suicide owing to suicidal tendencies. Allegations against the petitioner in the statement of brother of the deceased, are same as against father-in-law (husband of petitioner). Husband of petitioner has already been granted bail vide order dated 29th March, 2017 passed by a Bench of coordinate jurisdiction in Bail Appln. 865/2016. It is submitted that petitioner is suffering from arthritis. She is in custody for the last about 3 years. Material witnesses have already been examined. Learned APP submits that there are specific allegations against the petitioner that she used to tell the brother of deceased to either keep the deceased and her husband with him or give them a flat. Petitioner and her husband used to taunt and beat the deceased.
It would not be appropriate at this stage to render any opinion on merits or demerits of the case. Petitioner is a 60 years old woman and is suffering from arthritis. She is in custody for the last about three years. Substantial evidence has already been recorded. Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to her furnishing a personal bond in the sum of `20,000/- (Rupees Twenty Thousand Only) with one surety in the like amount to the satisfaction of the trial court.
