Heard learned counsel for the parties.

After arguing at some length, when it was pointed out to the learned counsel for the appellant that appropriate remedy which should be pursued by the appellant would be to file the affidavit in reply on its plea before the learned Single Judge in the pending writ petition, namely W.P.(C) No. 17401/2025 and seek vacation of the order dated 26.11.2025, learned counsel for the appellant states that the appellant may be permitted to withdraw this appeal with the liberty to approach the learned Single Judge by way of filing an application seeing vacation of the interim order dated 26.11.2025 along with the counter affidavit. He further states that the issue relating to the maintainability of the writ petition on behalf of the petitioner The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. therein may also be required to be considered by the learned Single Judge. 3.

Having regard to the aforesaid prayer made by learned counsel for the appellant, this appeal is dismissed as withdrawn with the liberty to the appellant to approach the learned Single Judge by way of moving an appropriate application seeking vacation of the interim order dated 26.11.2025 along with the counter affidavit.

We further provide that if any such application seeking vacation of the order dated 26.11.2025 is moved by appellant along with the prayer regarding non-maintainability of the writ petition, the same shall be considered and decided by the learned Single Judge after affording an opportunity of hearing to the petitioner therein with expedition say within a period of two months from the date such an application is moved, if possible.

The appeal stands dismissed as withdrawn with the liberty as prayed for.
