The accused/applicant seeks regular bail in case FIR No. 251/2024 of PS K. N. Katju Marg for offence under Section 103(1)/3(5) BNS. 2.

Broadly speaking, allegation against the accused/applicant is that he along with few others conspired and one of them stabbed the deceased to death. The CCTV footage allegedly captures the incident. That CCTV footage has been shown to me today in court.

As per prosecution, one eyewitness Vansh Jain is to be examined but has not been summoned for 02.04.2026, the date already fixed for trial. 4.

mother of the deceased claims herself to be the eyewitness, alleging that shortly before the assault she received phone call from the deceased and she reached there and witnessed the occurrence. Mother of the deceased is stated to have already been partly chief examined.

In the above backdrop, after addressing partly, learned counsel for accused/applicant on instructions seeks permission to withdraw this bail application with liberty to file afresh before the trial court after testimony of Vansh Jain and mother of the deceased.

Learned APP assures that Vansh Jain as well as mother of the deceased shall remain present before the trial court on 02.04.2026. 7.

Under these circumstances, the bail application and accompanying applications are dismissed as withdrawn with liberty as sought. 8.

Learned trial court is requested to ensure that testimony of Vansh Jain and mother of the deceased is completed on the same day (02.04.2026) but in case the same cannot be done, further testimony shall be recorded on the very next working day and thereafter on date to date basis, after which the accused/applicant shall be at liberty to file fresh bail application before the trial court.
