The present writ petition has been filed seeking quashing of the demand-cum-attachment notice dated 16th March, 2026 issued under Section 100 of the NDMC Act against the premises of the petitioner at 28, Hanuman Road, New Delhi-110001. A further direction is sought to the respondents to pass a fresh assessment order after granting an opportunity of personal hearing to the petitioners.

Earlier, the petitioners had filed a writ petition being W.P.(C) 9486/2021, which was disposed of by this Court by setting aside the impugned order dated 6th November, and directing the respondent/NDMC to pass a fresh assessment order taking into account the details furnished by the petitioner by their letter dated 28th October, 2020 W.P.(C) 3900/2026 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. and affording an opportunity of personal hearing to the petitioners. 3.

Mr. Udit Dedhiya, counsel appearing on behalf of respondent/NDMC, candidly admits that the assessment order has not yet been passed on account of a legal issue which is pending adjudication before this Court. 4.

Mr. Subhash C. Jindal, counsel appearing on behalf of the petitioners, submits that after receiving the attachment order, a sum of Rs.50,00,000/- has been paid by the petitioners to the respondent/NDMC. 5.

In view thereof, the present writ petition is disposed of while directing the petitioners to continue to pay the annual amount of property tax of Rs.11,15,700/-, till the time the assessment order is passed by NDMC. 5.1 The aforesaid direction shall apply from 1st April, 2026. 6.

This order is passed without prejudice to the rights and contentions of the petitioner.
