By the Writ Petition the petitioner seeks to impugn the closure notice dated 22.11.2019 and another communication dated 9.12.2019. A perusal of this impugned order shows that no personal hearing was given to the petitioner before passing a speaking order. Further, the orders are cryptic and cannot be said to be speaking order dealing with the contentions of the petitioner.

Let the Health Officer concerned treat this Writ Petition as a representation. He will also give a hearing to the petitioner/authorised representative of the petitioner on 25.2.2020 at 2:00 PM. Subsequent to the hearing, a reasoned order be passed taking into account the submissions of the petitioner within four weeks thereafter. The concerned Health Officer shall deal with the case and pass orders uninfluenced by any observations made by this court.

Till the speaking order is passed, no coercive action shall be taken against the petitioner. With the above, present petition stands disposed of. All pending applications if any also stand disposed of accordingly. FEBRUARY 10, 2020/n JAYANT NATH, J
