O R D E R

% 22.04.2026 By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks parole for 08 weeks in case FIR No.571/1997 registered under section 376(2)(g) of the Indian Penal Code, 1860 at P.S.: Kalyanpuri, Delhi. 2.

Notice on this petition was issued on 27.03.2026 restricted to prayer 'A' for grant of parole.

Status report dated 01.04.2026 has been filed by the State. 4.

It is observed that prior to filing of the present petition seeking parole, the petitioner was already on furlough granted by the prison authorities vidé order dated 25.02.2026, which furlough was to expire on 01.04.2026. mother passed-away on 25.03.2026; and vidé order dated 27.03.2026 passed in the present proceedings, it was directed that the furlough granted to the petitioner shall stand extended till the next date of hearing before this court.

The factum of the death of petitioner's mother has been verified vidé status report dated 01.04.2026; and the date of death has been confirmed.

Mr. Sarthak Maggon, learned counsel appearing for the petitioner submits, that the mother's chaliswan will fall on 05/06.05.2026; and since the petitioner has now lost both his mother and his sister, he needs to settle certain family affairs outside prison. 7.

Nominal Roll dated 06.04.2026 shows that the petitioner has served more than 15 years and 08 months of judicial custody; that his jail conduct over the last one year has been 'satisfactory'; and that he has been serving as 'factory sahayak'. The nominal roll also shows that the petitioner has earned remission of more than 03 years and 11 months; and that he has been granted interim bail, parole, furlough as well as emergency parole on several occasions between 2000 and 2026.

In the circumstances, Mr. Sanjeev Bhandari, learned ASC (Criminal) leaves it to the court to pass appropriate orders. 9.

Upon a conspectus of the foregoing facts and circumstances, this court is inclined to allow the present petition. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Accordingly, the petitioner - Tasleem s/o Islamuddin - is granted parole for 03 weeks, subject to the same conditions as were imposed by the prison authorities vide order dated 25.02.2026. 11.
