O R D E R

% 12.01.2016 In view of the notification No.2718/DHC/Orgl. dated 25.11.2015, issued under Section 4 of the Delhi High Court (Amendment) Act, 2015 (Act 23 of 2015), the suit is liable to be transferred to the court of the District Judge (South), Saket Courts, where the property is situated. However, it is pointed out that an order has been passed by this court on 06.02.2009 directing that the final hearing in the present matter be taken up alongwith the two other suits, namely CS (OS) Nos.595/1998 & 1695A/1996.

By a separate order passed today in those two suits, they have been transferred to the court of the District Judge (Central), Tis Hazari.

To ensure compliance of the order dated 06.02.2009, this court in exercise of powers under section 24 CPC directs that the present suit be also tried and heard by the District Judge (Central), Tis Hazari Courts, even though the suit property is situated at Mehrauli. It is made clear that in terms of the order dated 06.02.2009, the present suit and the other two suits, as aforesaid, shall be heard finally at the same time by the same court. However, the trial in the suits is not consolidated. The parties shall appear before the court on 05.04.2016. It is made clear that as both sides are duly represented today, no fresh notice for appearance shall be issued and the parties shall ensure their presence before the concerned Court on the aforesaid date.
