O R D E R

The present petition has been filed alleging willful disobedience of the order dated 21st December, 2023 passed by the Division Bench of this Court in W.P.(C) No. 6790/2022. By way of the said order, Grievance Redressal Committee ("GRC") was directed to hear the appeal of the petitioner and dispose of the same expeditiously, in any case within four weeks. th 2.

Though the petitioner was granted hearing by the GRC on 04 January, 2024, however, no final order was passed by the GRC. Thus, the present petition has been filed.

Today, learned counsel appearing for the New Delhi Municipal Council ("NDMC") submits that due hearing was granted to the petitioner th January, 2024. GRC attained the age of Superannuation on 03rd February, 2024, in the absence of the Chairman of the GRC, no final order could be passed. 4.

Therefore, it is submitted that a fresh hearing would have to be given to the petitioner, as and when a new Chairman of the GRC is appointed. 5.

Mr. Abhinav Singh, learned counsel appearing for the Government of National Capital Territory of Delhi ("GNCTD") submits that in view of the Model Code of Conduct imposed on account of the ensuing Lok Sabha Elections, appointment to the post of Chairman of GRC can be made only after the Elections.

Accordingly, it is directed that the respondent- GNCTD shall appoint a Chairman of the GRC expeditiously, as soon as the restrictions of the Model Code of Conduct, are lifted.

It is further directed that as and when the Chairman of the GRC is appointed, the petitioner shall be given a fresh hearing by the GRC at the earliest. Thereafter, the grievance filed by the petitioner before the GRC shall be disposed of expeditiously, preferrably within a period of two weeks of granting a fresh hearing to the petitioner. 8.

With the aforesaid directions, the present contempt petition is disposed of.
