% 31.07.2019 CRL.M.A.11988/2019 (modification of the order dated 21.5.2019) 1.

This is an application filed on behalf of the petitioner under Section 482 of the Code of Criminal Procedure, 1973, praying therein for modification of the order dated 21.5.2019 and adding the observations which got omitted from the aforesaid order- (i) details of 3 drafts handed over by the petitioner to the respondent No.2 vide draft No. 503066 for a sum of Rs.6,50,000/-, draft No.510736 for a sum of Rs.3,50,000/- and draft No.306980 for a sum of Rs.7,50,000/-, total amounting to Rs.17,50,000/- and (ii) Respondent No.2 handed over the key of the suit property to the petitioner. 2.

Respondent No.2, who is present in Court along with her counsel, submitted that she has already received three demand drafts ((DDs)- first bearing No.503066 for a sum of

Rs.6,50,000/-, second bearing No.510736 for a sum of Rs.3,50,000/- and the third bearing No.306980 for a sum of Rs.7,50,000/-, total amounting to Rs.17,50,000/- and the same stand encashed also. Respondent No.2 further submitted that as per the terms of the settlement, she has handed over the key of the property, i.e., third floor, Double Storey Quarters, Idgah Road, Sadar Bazar, Delhi to the petitioner. Hence, she submitted that the application may be allowed and this fact may be taken on record.

Accordingly, the aforesaid facts are taken on record. The application is disposed of, recording that the three DDs, amounting to Rs.17,50,000/-, were handed over to the respondent No.2 and that the key of the property in question, has been handed over to the petitioner.
