The limited plea of the petitioners is that on account of the random changes brought about in the manner in which Civil services exam were held by the UPSC, the petitioners should be given the benefit of a compensatory attempt.

The petitioners claim that in the past such benefit has been given to examinees in 1979,1992 and 2011.

I am informed by counsel for the petitioner that on account of the changes made in the Civil Services exam held in 2011, benefit of compensatory attempt was given in 2015.

Mr. Naresh Kaushik, who, appears on advance notice on behalf of the UPSC i.e. respondent no. 2 takes a preliminary objection which is that the jurisdiction in relation to this cause will lie with the Central Administrative Tribunal.

It is Mr. Kaushik's submission that the expression in "relation to recruitment" and "matters concerning recruitment" contained in Section 14 of The Administrative Tribunals Act, 1985 will include the plea advanced by the petitioners.

Having heard the submission of Mr. Kaushik, learned counsel for the petitioner seeks leave to withdraw the captioned petition to approach the Central Administrative Tribunal to agitate their grievance.

Accordingly, the captioned petition is, dismissed, as withdrawn with liberty, as prayed for.
