The sole grievance of the petitioner is as under: "a. Issue a Writ of Mandamus or any other appropriate writ, order or direction directing the Respondent No.2 Council to forthwith take up, hear and decide the reference filed by the Petitioner against the Respondent No. 3 under Section 18 of the Micro, Small and Medium Enterprises Development Act, 2006 bearing Application No. UDYAM-DL-030013923/S/00001 dated 21.07.2025, within a timebound period to be fixed by this Hon'ble Court;

b. Issue a Writ of Mandamus or any other appropriate writ, order or direction to the Respondent No.1 to ensure proper functioning of the Micro and Small Enterprises Facilitation Councils within its jurisdiction and to take necessary administrative measures to ensure disposal of references within the statutory period prescribed under the MSME Act; c. Issue such further directions as this Hon'ble Court may deem appropriate for streamlining the functioning of the Facilitation Councils within its jurisdiction and addressing the inordinate pendency of matters, including framing of appropriate guidelines or mechanisms to ensure time-bound adjudication of references;

It appears that the petitioner's application under Section 18 of the Micro, Small and Medium Enterprises Development Act, 2006 (Act) is pending for consideration since 21.07.2025. Except for one hearing, which was conducted on 14.11.2025, it appears that no further steps have been taken.

Under Section 18 (5) of the Act, references shall be decided within ninety days from the date on which they were made. The said provision is extracted below, for reference:

"18. (5) Every reference made under this section shall be decided within a period of ninety days from the date of making such a reference" 4.

In view thereof, the Court directs respondent no.2 to decide the petitioner's application with due expedition, not beyond two months from the date of receipt of a copy of the order passed today. 5.

Petition stands disposed of.
