CM(M) 170/2020 & CM APPL. 5451/2020 The only dispute in this case is whether the time for filing the written statement ought to be condoned or not. The Trial Court seems to have taken umbrage to the Petitioner's conduct on the ground that the Petitioner was telling a lie to the Court.

Summons were served in the suit on 14th October, 2019, as per the report of the process server. Written statement was filed on 25th November, 2019. The written statement is filed at best with a delay of 10 days i.e., within 40 days after service. Lawyers' were on strike during the intervening period. Considering these facts, the written statement is taken on record and the delay in filing is condoned subject to payment of Rs.10,000/- as costs. With these observations, the petition and all pending applications are disposed of.
