O R D E R
% 22.02.2019 De hors the personal allegations levelled against the natural father of the petitioner's minor child, the learned counsel for the petitioner submits that the child, aged about 6 years, has been studying in Delhi and her removal from the jurisdiction of this Court is likely to have an adverse effect on her studies and upbringing, unless it is mutually agreed to by both the parents. The child's upbringing has been done entirely by the petitioner without any contribution from the husband - respondent No.2. The petitioner seeks protection of this Court for herself as well as her daughter from the daughter's forcible removal from Delhi by respondent No.2-a resident of the State of Kerala.
Issue notice.
Mr. Sanjay Lao, the learned Additional Standing Counsel accepts
notice on behalf of the State. He submits, upon instructions, that on receipt of advance copy of this petition, the police has contacted the petitioner and has assured due safety and security to her as well as of her daughter. She has been given three telephone numbers i.e. of the Station House Officer of the area concerned, one Sub Inspector and the Beat Constable. These numbers shall be kept operational at all times so that in case of any exigency, the petitioner may intimate on either of the numbers. The Court is assured by the learned counsel for the State that any message received on the said numbers or on any other telephone number of the police either by way of a telephone call or SMS shall be immediately responded to. Additionally, a Beat Constable from Police Station Kirti Nagar, Delhi, shall regularly appraise the situation.
Should the petitioner shift her address to the jurisdiction of any other Police Station in Delhi, the same protection shall be granted to her by the SHO of the subsequent Police Station as well. The petition stands disposed-off in terms of the above. A copy of this order be given dasti to the learned counsel for the parties under signature of the Court Master.
