The petitioner is aggrieved by dismissal of his revision petition by the Principal District and Sessions Judge by order dated 04.10.2024 (hereafter 'the impugned order'). 2.

By the impugned order, the learned Court of Sessions dismissed the revision petition noting that none had been appearing for the petitioner from the last three dates. 3.

The learned counsel for the respondent states that she has no objection if the impugned order is set aside if the respondent is adequately compensated.

Therefore, purely in the interest of justice, this Court is of the opinion that one last opportunity shall be granted to the petitioner to address arguments before the Court of Sessions. 5.

In view of the above, the present petition is allowed and the matter is remanded back to the Court of learned Principal District and Sessions Judge for passing an order on merits after hearing the parties.

CRL. REV. 138/2022 is, therefore, restored to its original number.

The petitioner is also directed to pay a cost of ₹30,000/- to the respondent.
