The petitioner has filed this application for deciding the matter on merits, but when the application is taken up for hearing, Mr. Naveen Kumar Chauhan, learned counsel for the petitioner, states that the petitioner is satisfied with the action taken by Municipal Corporation of Delhi ["MCD"] in respect of the unauthorised construction in Property No. 78-B, Ward No. 1, Mehrauli, New Delhi ["Subject Property"]. He therefore, seeks permission to withdraw the writ petition. 2.

Mr. Aditya Vaibhav Singh, learned counsel for MCD is present and has no objection.

taken on board and is dismissed as withdrawn. 4.

It is made clear that the aforesaid order will not prejudice the power of MCD, available in law, to take action against the unauthorised construction in the subject premises, nor it will prejudice the rights and remedies available, in law, to the owner/occupants of the Subject Property.

The next date of hearing in the writ petition i.e. 27.11.2024 stands cancelled.
