% 14.09.2016 By the present petition, the petitioner seeks anticipatory bail in case FIR No.1622/2015 under Sections 376/328/323/506 IPC registered at PS Janakpuri.
The allegations in the complaint made by the prosecutrix are that she was friendly with the petitioner and in June 2012 she went to the house of the petitioner as his mother had called her. When she reached home of the petitioner, her mother left for market. Thereafter, the petitioner gave her cold drink and she became unconscious. When she regained consciousness, she found herself in a condition that she realized that she had been raped. When she confronted the petitioner, he assured her of marriage and on the assurance of marriage he raped her number of times. Finally in March, 2013
the petitioner assured her that he would marry her after solemnization of marriage of his brother.
The complainant had given a complaint to the police on 6th December, 2015 which she withdrew on the same date. Later on the complaint dated 19th December, 2015, the above noted FIR was registered. During the course of investigation the petitioner has already joined the investigation and handed over his mobile phone. The complainant stated that she had been receiving threatening calls from one Meera Mishra who was the friend of the petitioner and thus further status report was called for.
A status report has been handed over as per which on the complaint of threat received by the prosecutrix, investigation was carried out and it was revealed that the URL (Uniform Resource Locator) account number of the face book of alleged Meera Mishra was actually of registered in the name of Anuj Kumar Mishra and the complainant was in constant touch with said Anuj Kumar Mishra. The said Anuj Kumar Mishra by faking himself as Meera Mishra was sending the messages on which a separate FIR No.597/2016 under Sections 66D and 67A of Information Technology Act was registered. No contact was found between the petitioner and Anuj Kumar Mishra.
Considering the facts and circumstances of the case, I deem it fit to grant anticipatory bail to the petitioner. It is thus directed that in the event of arrest, the petitioner be released on bail on his furnishing a personal bond in the sum of `25000/- with one surety of the like amount subject to the satisfaction of the Arresting Officer/SHO concerned and further subject to the condition that he will join the investigating as and when directed by the
investigating officer and will not leave the country without prior permission of the Court concerned.
Petition is disposed of.
