2020-02-11Hon'Ble Mr. Justice Rajiv Shakdher2 pages

$~41 * IN THE HIGH COURT OF DELHI AT NEW DELHI + W.P.(C) 1571/2020 ARYA COLLEGE OF EDUCATION ..... Petitioner Through:

Mr. Sanjay Sharawat with Mr. Divyank Rana, Mr. Abhishek Dhankar and Mr. Ashok Kumar, Advocates.

versus NATIONAL COUNCIL FOR TEACHER EDUCATION AND ANR.

..... Respondents Through:

Ms. Arunima Dwivedi, Standing counsel with Ms. Niharika Rai, Advocate.

CORAM:

HON'BLE MR. JUSTICE RAJIV SHAKDHER

O R D E R

% 11.02.2020 1.

Issue notice to the respondents.

2.

Ms. Arunima Dwivedi accepts notice on behalf of the respondents.

3.

In view of the order that I propose to pass, Ms. Dwivedi says that she will argue on the basis of the record presently available. 4.

Mr. Sharawat limits his grievance, for the moment, to the purported failure of the respondents in adjudicating upon the show cause notice (in short "SCN") which was issued by the Northern Regional Committee (in short "NRC") pursuant to the decision taken at its 308th meeting held between 25.09.2019 and 27.09.2019. W.P.(C) 1571/2020

5.

Mr. Sharawat says that the petitioner has already filed a reply dated 08.11.2019, despite which, there has been no movement in the matter.

6.

To be noted, the petitioner seeks approval of its application to run B.A.B.Ed/B.Sc.B.Ed course. This application was, apparently, filed on 11.06.2015. Since then, the petitioner, has approached this Court several times.

7.

This history of the case need not be replicated in the present proceedings given the limited direction that the petitioner seeks 8.

Accordingly, the captioned petition is disposed of with a direction to the NRC to adjudicate upon the SCN issued to the petitioner pursuant to its decision taken in its 308th meeting held between 25.09.2019 and 27.09.2019.

8.1 It is made clear that the adjudication will take place (if not already carried out) based on the record, presently, available. 8.2 In case, the petitioner's reply is on record as contended before me, the same will be taken into account in adjudicating upon the SCN.

9.

Needless to add, this exercise will be carried out by the NRC with due expedition keeping in mind the cut-off date for the academic session 2020-2021 i.e. 03.03.2020.

10.

Thus, the NRC will take up the SCN for adjudication in its next meeting.

11.

Dasti under signatures of the Court Master.
