Petition under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for has been filed by the Petitioners for quashing of FIR No.0475/2019 under Sections 307/120B IPC registered at PS: Dwarka South and all consequential proceedings emanating therefrom, in terms of Settlement Agreement dated 21.06.2024.

Learned APP for the State and learned counsel for Respondent No.2 appear on advance Notice and accept Notice.

The case of the prosecution is that Respondent No.2 was attacked with a knife and his neck was slit and an endeavour was made to kill him. Multiple injuries were suffered by him, as per his MLC. On the basis of aforesaid Settlement Agreement dated 21.06.2024, earlier quashing Petition bearing CRL.M.C. 5010/2024 was filed by the Petitioners, but the same got withdrawn and disposed of.

As per learned counsel for the Petitioners herself, there is no change of circumstances except that one years has passed and no prosecution witness has been examined.

Reliance has been placed on Superintendent and Remembrancer of Legal Affairs, West Bengal vs. Mohan Singh and Ors., (1975) 3 SCC 706; Vinod Kumar, IAS vs. Union of India & Ors., 2021 SCC OnLine SC 559; and Muskan Enterprises and Ors. vs. The State of Punjab and Ors., MANU/SC/ 1431/2024.

On a query, it has been informed that essentially because of the compromise inter se the parties, the injured had not appeared before the learned Trial Court for recording of his evidence. Submissions heard and record perused.

First and foremost, similar Petition for quashing of same FIR on the basis of same Settlement Agreement has already been dismissed by a Coordinate Bench of this Court vide Order dated 15.07.2024. Secondly, considering the gravity of the allegations/offence and the nature of injuries suffered by Respondent No.2, it is not a fit case for quashing. 11.

Accordingly, Petition along with pending Applications is dismissed. NEENA BANSAL KRISHNA, J.
