Having heard the learned counsels of the parties, the present application for modification/recalling raises a trivial issue which can be decided forthwith.

It is submitted that the matter has not been settled between the parties as such. withdraw the present writ petition, so as to consider him granting appropriate relief, if so advised, in the pending consumer case before the New Delhi District Consumer Forum.

The applications are disposed of with the directions that the present writ petition stands withdrawn. The petitioner shall be at liberty to pursue his remedy before the New Delhi District Consumer Forum in accordance with law. The aforesaid order is modified to that extent.
