The petitioner is currently undergoing a sentence of seven years' rigorous imprisonment pursuant to his conviction for offences under Sections 376 and 506 of the Indian Penal Code, 1860 and Section 4 of the Protection of Children from Sexual Offences Act, 2012 ["POCSO"] in connection with FIR No. 270/2013 registered at Police Station Sangam Vihar.

The present petition has been filed seeking parole to enable the petitioner to file a Special Leave Petition ["SLP"] against the judgment dated 22.11.2025 passed by this Court in CRL. A. 90/2017, whereby his appeal challenging the conviction and sentence came to be dismissed. 3.
Ms. Gunjan Sinha Jain, learned counsel for the petitioner, submits that the petitioner had moved an application dated 09.12.2025 before the competent authority seeking parole; however, no response has been received.

Mr. Sanjeev Bhandari, learned Additional Standing Counsel for the State, who appears on advance notice, submits that the said application is presently under consideration and that a decision thereon shall be taken within a period of ten days from today.

The present petition, alongwith pending applications, is disposed of, binding the respondent to the aforesaid submission. The rights and remedies of the petitioner remain reserved.

Mr. Bhandari submits that, while taking a decision in the matter, the competent authority shall bear in mind the decisions of this Court dealing with parole applications filed by convicts under POCSO, seeking parole for the purpose of filing a SLP1.
