The present petition has been filed under Articles 226/227 of the Constitution of India, 1950, seeking issuance of a Writ in the nature of Certiorari to quash the order dated 02.11.2023 passed by the learned Central Administrative Tribunal, Principal Bench, New Delhi [hereinafter referred to as „Tribunal‟], whereby the Original Application (O.A.) filed by the Petitioner, came to be dismissed. 2.

The brief facts leading to the filing of the present petition are set out hereinafter.

The Petitioner belongs to Schedule Caste (SC) category and seeks appointment to the post of Welfare Officer in the Social Welfare Department, Government of NCT of Delhi, under Post Code 55/15. In furtherance thereof, he applied for the said post pursuant to the Advertisement dated 20.10.2015, issued by the Respondent No.2/ Delhi Subordinate Services Selection Board (DSSSB), whereby six The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. vacancies, including one vacancy reserved for the SC category, was advertised.

Following the completion of selection process, the Respondent No.2 declared the first result, wherein one candidate in the SC category was provisionally selected. Subsequently, vide Result Notice No. 763 dated 07.02.2019, the said candidate was shifted to the Unreserved (UR) category, and another candidate was shortlisted in the SC category for appointment.

Upon conclusion of the recruitment process, the Petitioner was placed at Sr. No.3 in the Waiting List for the aforesaid post. In terms of Notification dated 13.06.2013 issued by the Respondent No.2, the validity of the Waiting List was one year. Undisputedly, the Waiting List lapsed on 08.04.2019.

The Petitioner contends that on account of non-joining of a candidate placed at Sr. No.2 in the Waiting List, a cause of action accrued to him on 19.11.2019. However, by the said date, the period of validity of the Waiting List had already expired in terms of the circular dated 13.06.2013.

Keeping in view the aforesaid factual position, this Court finds no infirmity, illegality or perversity in the conclusion drawn by the Tribunal.

Consequently, the present Petition, along with pending application, stands dismissed.
