O R D E R

% 25.02.2019 CM APPL. 8848/2019 (Exemption) Allowed, subject to all just exceptions.

This application is, accordingly, disposed of. W.P.(C) 1899/2019 Vide the present petition, the petitioner seeks direction which is as under:

(a) "Issue a writ in the nature of mandamus or any other appropriate writ or direction or order, directing the respondent nos.1 & 2 to implement the recommendations of Seventh Pay Commission in the terms of order dated 17.10.2017 issued by respondent no.3 and

direct them to re-fix the salary and to pay the arrears of salary, gratuity, commensurate arrears, consequential benefits along with transport and dearness allowance in terms of order dated 17.10.2017 along with interest to the petitioner immediately/ forthwith.

(b)Direct the respondent no.1 and 2 to pay interest @ 12% on the outstanding arrears of salary from 30.06.2018 as the respondent no.1 school was required to pay arrears in two instalments latest by 30.06.2018 as per order dated 17.10.2017 issued by the respondent no.3."

In view of the reasons stated in the present petition and submission of the counsel for the petitioner, I hereby dispose of the present petition, without issuing notice by directing the respondents to take final decision on order dated 17.10.2017 issued by Directorate of Education, Government of NCT of Delhi within six weeks from the receipt of this order. The decision taken shall be communicated to the petitioner in writing within one week thereafter.

Needless to state that if the petitioner is still aggrieved by the decision to be taken by the respondents, the petitioner is at liberty to challenge the same before the appropriate Forum.
