O R D E R

The present petition has been filed by the petitioner seeking quashing of the proceedings emanating from the complaint filed against the petitioner by Smt. Neetu Singh / respondent no. 2 before the Bar Council of Delhi. 2.

Learned counsel for the Bar Council of Delhi submits that the complaint of the respondent no. 2 was considered by the Full-House of Bar Council of Delhi and an order dated 04.10.2024 was issued, whereby the complaint was referred to the Disciplinary Committee for further proceedings. It is also pointed out that the Disciplinary Committee is currently seized of the complaint.

Attention is drawn to the fact that in terms of the applicable Rules (Bar Council of India Rules, framed under the Advocates Act, 1961), an elaborate procedure is set out which is to be followed by the Disciplinary The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Committee of the Bar Council. The framework of these rules is to provide adequate opportunities to the concerned parties to present their case fully, and also afford them an opportunity of hearing and adducing evidence. As such, in the present matter, it is submitted that the Disciplinary Committee will pass an appropriate order only after affording an opportunity to the petitioner as well as the respondent no. 2 to present their case. 4.

It is assured that the final order, that will be passed in the abovementioned complaint, would necessarily take into account all relevant aspects of the matter along with the applicable statutory/regulatory provisions.

In the aforesaid circumstances, this Court is not inclined to entertain the request of the petitioner for quashing the ongoing proceedings at this stage. It shall be open for the petitioner to participate in the proceedings before the Disciplinary Committee of the Bar Council of Delhi and present its case.

The Disciplinary Committee shall conduct the proceedings strictly in accordance with the prescribed Rules and the applicable provisions of the Advocates Act, 1961, and pass an appropriate order/s. 7.

The present petition is disposed of in the above terms. Pending application also stands disposed of.
